Participation in the raffle of:
1x Hohe Salve holiday voucher worth € 200.
is free of charge.
To participate, it is necessary that all personal details are true. Employees of the organiser, its affiliated companies, including their relatives, are excluded from participation.
The competition starts on Thursday, 06.05.2021, at 10:00 am and ends on Monday, 17.05.2021 at 12:00 pm. The winner will be announced in writing by email on Friday, 17.05.2020.
The organiser is authorised to exclude individual persons from participating, if corresponding grounds exist, such as breach of the conditions of participation, participating via third parties (agents, collective participation, etc.), registering through a provider, whose business objection includes manipulating raffles or other impermissible manipulation of the raffle, etc.. In such cases, prizes may also be retroactively revoked and reclaimed.
2. Selection of the prizewinner
The prize winner is selected among all entrants after the end of the raffle, who have met the requirements under Point 1. The winner of the starting place will be chosen at random among all entries. Only one prize is possible per entrant and raffle. Prizes cannot be redeemed for cash or transferred to other persons. The prize winner will receive a reply to his/her comments after selection. Should a prizewinner not notify the organiser within 48 hours, the claim to the price is forfeited and a replacement prize winner will be selected using the same procedure. This procedure will be carried out for a maximum of three repetitions. Entrants promise not to write any illegal or insulting content. Announcement of the prizewinner is without liability. Any recourse to courts of law is excluded.
3. Changes to the conditions of participation / Cancellation of the raffle
The organiser reserves the right to change the conditions of participation or to cancel or suspend the raffle or the draw completely or in parts for significant reason without prior announcement. This applies in particular when circumstances exist which can disrupt or impede the planned sequence of the raffle or draw, such as in case of computer viruses, errors to the soft- and / or hardware and / or for other technical reasons, which involve a not only insignificant disturbance. This also applies in case that the completion is not only insignificantly affected or excluded for legal reasons, such as in case of manipulation or attempted manipulation, which affect the administration, the security, the integrity and / or regular and correct completion of the draw. Insofar as disruption or cancellation results from the conduct of an entrant, the organiser shall be authorised to claim compensation for the damage incurred from this from that entrant.
4. Liability of the organiser
The organiser Holiday Region Hohe Salve shall be liable – for whatever legal reason – only, in case of culpable breach of a significant obligation when conducting the raffle or if damage can be attributed to intent or gross negligence.
If the organiser is liable for breaching an obligation pursuant to the paragraph above, without intent or gross negligence being existent, liability shall be limited to the extent, the occurrence of which the organiser would have had to typically expect at the start of the raffle.
The above provisions do not apply in case of culpable injury to life, body and health, as well as for claims for which liability is mandatory according to law. Insofar as the liability of the organiser is excluded or limited pursuant to the above provisions, this shall also apply to the personal liability of institutions, employees, representatives and vicarious agents.
The raffle is not connected to Facebook and is in no way sponsored, supported or organised by Facebook.
5. Data privacy
Entrants expressly declare their consent to their comments posted on Facebook being published. By participating in the raffle, the entrant expressly consents to the organiser saving the data required for this, e.g. first name, name and email address, for the duration of the raffle and beyond. It is within the entrant’s discretion to revoke this consent at any time and thus withdraw from participation. The organiser points out that none of the personal data of the entrant will be made available to third parties. The prizewinner agrees to his/her name being published. The rights according to the Federal Data Protection Act remain unaffected. Data collected will be used by the organiser and its associated companies, for market research, newsletter, marketing and advertising purposes.
Should individual provisions of these conditions of participation be or become void or illegal, the validity of the remaining provisions shall remain unaffected by this. They will be replaced by an adequate provision, which comes as close to the intent of the void provision as possible. Austrian law applies.
